Terms of Service

These terms govern your use of Fios AI. Different sections apply depending on whether you are a recruiting organisation using Fios AI to assess candidates, or a candidate invited to take an assessment.
1. Who these terms are for
Fios AI provides an AI-assisted recruitment platform. “We” and “Fios AI” mean MJL Executive Ltd, trading as Fios AI. These terms apply to two groups: recruiting organisations (and their users) who subscribe to the platform, and candidates who are invited to complete an assessment. Where a section is specific to one group, it says so.
2. The service
Fios AI lets a recruiting organisation invite candidates to a structured, AI-assisted assessment that may include skills tests, an AI interview, identity verification and integrity checks. The platform produces a structured report that a human at the recruiting organisation reviews before making any decision.
The AI produces recommendations only. Fios AI does not make hiring decisions, and no decision with legal or similarly significant effect is made by the system alone (see our Privacy Policy and the EU AI Act Article 14 / GDPR Article 22 safeguards).
3. Candidates
By taking an assessment, you agree that:
- you will provide accurate information and complete the assessment yourself, without impersonation or outside assistance where a test asks you to work alone;
- the consents you give (for recording, AI assessment, biometric checks and integrity scans) are recorded, and you can withdraw them as described in the Privacy Policy;
- a human at the recruiting organisation, not Fios AI and not the AI alone, decides on your application; and
- you can ask for human review, an explanation of the logic, and to contest a decision.
Taking an assessment is free for candidates. Nothing in these terms removes any right you have under data protection or consumer law.
4. Recruiting organisations
If you use Fios AI to assess candidates, you agree that:
- you will use the platform only for lawful recruitment, in line with employment and equality law and the instructions for use we provide;
- you act as the human overseer of the AI output: a named person must review the evidence and record a reasoned decision before any outcome affects a candidate;
- you will not use the platform to make solely automated decisions, to infer candidates’ emotions or sensitive characteristics, or for any prohibited practice under the EU AI Act; and
- you are responsible for your own lawful basis and notices toward candidates for the parts of the process you control, and will enter into the data processing terms we provide.
5. Intellectual property
Fios AI and its underlying software, model configuration, designs and content are owned by us or our licensors. We grant recruiting organisations a non-exclusive, non-transferable right to use the platform for the duration of their subscription. You keep ownership of your own data; you grant us the rights needed to operate the service for you.
6. Availability and changes
We aim to keep the platform available and accurate, but we provide it on an “as is” basis during the pilot and do not guarantee uninterrupted service. We may improve, change or withdraw features, and we will give reasonable notice of material changes that affect you.
7. Liability
To the extent permitted by law, Fios AI is not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or breach of your data protection rights. Recruiting organisations remain responsible for their own hiring decisions.
Nothing in these terms removes or limits any right you have that cannot be excluded under applicable law. In particular, the “as is” wording above describes the free pilot service and does not override the statutory rights of a paying recruiting organisation under the Irish Consumer Rights Act 2022 or other mandatory consumer-protection law where it applies.
8. Governing law
These terms are governed by the laws of Ireland, and the courts of Ireland have jurisdiction, without affecting any mandatory consumer-protection rights you have where you live.
